What is a will?
A will is your expression of what you want to have happen after you've passed away. You're putting in black and white writing what you want done with your assets, who is going to inherit those assets, and who is going to be in charge. The one thing that people think that a will does or does not do is a will not avoid probate. I like to say that a will, a last will and testament, is like a love letter to the probate judge. The probate court is required to give authority to those individuals, your personal representative who's in charge, giving them that authority to be able to administer your estate and make sure that the assets that you have go to the inheritors, your beneficiaries, in the manner in which they are supposed to go.
