A veteran or a veteran's spouse may have many too assets under the aid and attendance rules, and order to qualify. It really depends upon the state of the regulations because those regulations are in a flux at this moment in time. There is a proposal by federal regulation to implement a look back period as much as three years. Right now under current law as it exists in 2016, those proposed regulations have not been implemented, which means it is allowable to transfer any excess assets over the allowable limit to obtain the aid and attendance benefit without incurring any type of penalty. Again it's import to understand where are the proposed regs has those regulations been implemented, and work with a qualified elder law attorney to keep you up-to-date on whether or not a spend down is a possibility.
