What income is available to a spouse that is not in need of Medicaid for long term care benefits?
When you are a spouse who is not needing the Medicaid benefit but your sick spouse is needing the Medicaid benefit, you are entitled to keep all of your own income. That means you can rely upon your own income and if you need some of the income of your sick spouse who is in the nursing home or has qualified for Medicaid, there is a formula by which you can receive and keep some of his income, the sick spouse's income. If the formula doesn't work out to give you enough money, then a qualified elder law attorney can go to court for you and actually allow you to obtain even more of the income so that you won't feel as if you do not have enough income to meet your monthly needs.
