Are the eligibility rules for community based Medicaid services the same as for nursing home?
In some instances, the rules are the same across the board for all long-term care benefits. The income and asset rules for the nursing home versus the assisted living facility versus the in-home, may be similar, but in application, a qualified elder law attorney will explain to you how those things can be very different, either in the home or at the assisted living facility, when we're actually dealing with a waiver versus an entitlement. It is very important to note that in some instances, children may have to contribute some of their own assets or income for coverage in the home, or at the assisted living facility, or maybe even the spouse of a sick person who has those coverages in the home or at the assisted living facility. They may have to contribute some of their own income and assets, so it's important to understand the rules may be the same, but the application of those rules can be very different and have very, very different effects.
