Guardianship typically refers to an incapacity proceeding to appoint a guardian under Chapters 7 and 44 in Florida Statutes. It is typically applicable to a person who had the capacity but has lost it either through dementia, senility, a brain injury or something of that sort. Guardianship advocacy on the other hand, is proceeding under Chapter 393 and involves an individual with a developmental disability. Someone who has not had capacity as to certain of their rights at a very early age.
